8. 電腦軟體下載
4.2 意思是你要是下載了話也不能退了? 這應該和歐盟一樣了吧!?
- 您可以於Apple Store 使用一個有效的Apple Store 帳號選擇購買可下載的軟體。在結算時，我們將獲取得您提供給Apple Store 的信用卡的授權。一旦信用卡授權被接受，您將以鏈結的形式接收指令以開始下載您的軟體。
- 如果在下載過程中因任何原因傳輸中斷，您可以使用您的Apple Store 帳號和密碼重新開始下載過程。一旦完成您的指令，您將接收到一封單獨的電子郵件以確認您的購買資訊。
- 如果信用卡授權不被接受，您將收到詳細步驟以完成您的購買。
- 由於軟體下載購買不可退款，請仔細閱讀電腦軟體下載的產品資訊。
5.電腦軟體下載適用的銷售稅將根據購買者居住地管轄法律的要求收取。
那第8大項, 就說明不能退費了.
假設台北市政府真的是這麼威, 那臺灣蘋果的銷售及退款政策也不會這樣寫了吧!?
說穿了根本是怕有民怨所以APPLE喊喊有比照法令辦理給台北市政府一個台階下而已.
而台北市政府也沒趕去要APPLE修改他的銷售及退款政策. 怕到時候沒APPLE也沒ANDROID可玩的民眾會爆動 XDD
我猜要是連蘋果都玩不下去的話, 臺灣經濟會更慘吧!?
我可以說政府是看在郭董的面子上才沒有去找蘋果"依法行政"嗎?
所以...就官方文件來看..GOOGLE允許退費 APPLE不允許退費, 臺北市政府則是說 你們都要退費而且還是14天之內都可以退! APPLE給政府台接下, 繼續賣, GOOGLE拒絕所以撤出臺灣. 而事後也沒聽過政府有對APPLE做定期的抽檢~ 詭異吧? 反正要是動了IPHONE等於是跟政府自己過不去, 畢竟郭董應該也跟銀行體系貸了不少錢去蓋廠吧? 這個聯想應該不過份吧!? -

歐盟的規定我是不清楚，只是以我自己來說，"軟體" "音樂" 這種東西，使用感覺因人而異，而且一定要使用後才知道喜不喜歡，跟銷售通路無關，難道你現場看到遊戲的包裝盒就知道遊戲好不好玩??
(好啦如果畫質直接GG的話....可能就會知道XD
這不像一般商品因為是網購.電視購物，才無法實際看到商品，我個人覺得這在
邏輯性上，實在有不合理之處。
而且很多東西可以退費是指"未使用"的情況下你有猶豫期，那相對來說...如果都安裝了，
就等於是使用它了不是嗎，所以重點不在於15分鐘 還是 7天，而是在怎樣的情形下，
可適用消費者保護法，跟時間長短無關。 -
北市府竟然可以決定全台用戶的生死?

Jason說：我覺得7天有點太長了，如果縮短在3小時之內應該大家都可以接受才對各位手上有 Android 手機的使用者，應該都還記得一年半以前 Google ... 恕刪
畢竟有些遊戲是購買後還要下載大量的檔案，15分/30分/1小時，可能真的短了些。
題外話
前天商店可以下載付費軟體，然後下午之後又沒有了!!!

The period under which consumers can withdraw from a sales contract is extended to 14 calendar days (compared to the seven days legally prescribed by EU law today). This means that consumers can return the goods for whatever reason if they change their minds.

就說歐盟說14天內也可以退, 但若在往下看會發現.Extra protection for lack of information: When a seller hasn’t clearly informed the customer about the withdrawal right, the return period will be extended to a year.
Consumers will also be protected and enjoy a right of withdrawal for solicited visits, such as when a trader called beforehand and pressed the consumer to agree to a visit. In addition, a distinction no longer needs to be made between solicited and unsolicited visits; circumvention of the rules will thus be prevented.
The right of withdrawal is extended to online auctions, such as eBay – though goods bought in auctions can only be returned when bought from a professional seller.
The withdrawal period will start from the moment the consumer receives the goods, rather than at the time of conclusion of the contract, which is currently the case. 在歐盟的認定, 數位產品試用第9條, 當使用者開始下載數位產品時, 退費的權利就終止了
9) Better consumer protection in relation to digital products
Information on digital content will also have to be clearer, including about its compatibility with hardware and software and the application of any technical protection measures, for example limiting the right for the consumers to make copies of the content.

所以還是沒解...GOOGLE現有的5分還是15分內按鈕的退費機制, 其實已經是比歐盟鬆了..
我們居然要14天, 要不到還一堆人罵Google.
